These terms and conditions form the basis of the agreement between Your Market Place and you as the business (The Business) to access the services offered by Your Market Place. They operate in conjunction with the following Your Market Place policies:
• Your Market Place General Terms of Use; and
• Your Market Place Privacy Policy.
Any business wishing to access services offered by Your Market Place must abide by each of these policies. Failure to do so may result in being removed from, or prohibited access to, the Your Market Place site.
Your Market Place is not liable for any loss, whether of money (including profit), goodwill, reputation, any special, indirect, or consequential damages arising out of, or in connection with, your use of Your Market Place. To the extent permitted by law, we disclaim all warranties.
You are solely responsible for all information that you submit to Your Market Place and any loss or damages arising from, or in connection with, the use of the Your Market Place site. We reserve the right at our absolute discretion to refuse or delete content that we believe is inappropriate or breaches any of our policies. We also reserve the right at our absolute discretion to restrict the Business’ usage of or access to the site either temporarily or permanently, or refuse a Business’ registration. We will use reasonable endeavours to vet items that we consider, in our absolute discretion, to be potentially offensive or inappropriate. We do not however accept any liability for monitoring Your Market Place or for unauthorised or unlawful content on Your Market Place or use of Your Market Place by users or Businesses.
In order to use Your Market Place, the business must be a registered business with a valid Australian Business Number. The Business needs to have business premises, office, or similar location within the region (Your Market Place business services are for local businesses advertising to their local customers).
The principal of the business needs to be aged 18 years and over.
We reserve the right, in our absolute discretion to refuse to register any Business. We also reserve the right, in our absolute discretion to remove any Business from the Your Market Place website that we believe, in our absolute discretion, does not or no longer conforms to, the objectives and standards of the Your Market Place site or may damage the reputation or the goodwill of the Your Market Place site.
The business needs to select a service option at the time of purchasing the services. Payment must be made prior to commencement of the service. The exception to this is when you have a free period of use, payments will need to be made a month in advance when the free period concludes. Services are outlined at Attachment A below.
Rates for services are subject to change at any time and will take effect once the current purchase option has expired. All payments are to be made electronically by direct credit or by other electronic means as set out by Your Market Place.
The business can cease and cancel services from Your Market Place at any time by notification in writing to Your Market Place. Any refund payable will be based upon the portion of time unused less an administrative fee of $20.
Your Market Place reserves the right to withdraw or cancel any advertisement or profile it considers to be potentially offensive or inappropriate in its absolute discretion. This will result in a refund payable based upon the portion of time unused less an administrative fee of $20.
Your Market Place may also withdraw or cancel any advertisement or business profile it considers that may, or does, damage the reputation and image of Your Market Place in their absolute discretion.
Your Market Place will not provide your confidential information to third parties without your express permission. For more information on how we respect your privacy, please refer to our Privacy Policy.
Your Market Place does not take responsibility for any information posted on the Your Market Place website. The Your Market Place site may contain links to other websites. Your Market Place is not responsible for the privacy practices or the content of those websites.
These terms and conditions can be amended at any time by Your Market Place effective immediately. Your Market Place will notify The Business of any change to the terms and conditions by email.
Your Market Place reserves the right to send administrative messages to the Business by email through the Your Market Place site.
The sections below provide key specifications for each service on Your Market Place. For pricing information, please see the Business Services Menu.
Your Market Place business services revolve around your business profile. The business profile is used with Your local business, Your local takeaway and Your local providore. The business profile includes:
• Your business name and logo
• Your business positioning line
• Contact details, including link to your website as appropriate
• Up to 500 words of free text
• Up to 5 images
• Key word search
• A large advertisement at the base of your business profile, 560px wide by 230px high
• One advertisement down the right hand side of your business profile, either rectangular (185 px wide by 250 px high), or square (185 px wide by 165 px high)
You can edit or update Your business profile at any time for no further cost.
Your Market Place can provide you with data on the traffic your business is attracting on the site. This service forms part of the package, and you will receive on an annual basis the following:
• The number of impressions – the number of times your advertisement has been seen;
• The number of clicks – the number of times a person has clicked on your listing and/or advertisement; and
• The number of times a person has clicked through to your website.
Your Market Place may request changes to the business profile or refuse to upload the business profile if Your Market Place deems that it may potentially cause offence or be otherwise regarded as being inappropriate to the broader community. The approval process will be completed by Your Market Place within 72 hours days.
Please note that while Your Market Place reserves the right to place cross selling material on an individual business profile; this material will be about the website, and not any other business.
Your local takeaway is for our restaurants, cafés, convenience food businesses, and businesses selling takeaways. It includes a business profile page and you can choose to add your menu for an additional fee. You can either upload your own menu or create your menu using our site. You can update or remove/add your menu at any time.
There is also a future option for online ordering and payment. Your Market Place reserves the right to work with any business in trialling its online ordering and payment system. For more information on this, please contact Your Market Place.
Your local providore is for our small specialty stores selling fresh produce, food and beverage supplies. It includes a business profile page and you can choose to add your product list and/or provide online ordering and payment for your customer for an additional fee.
Option one: static product lists You can choose to upload your own product list or create your product list using our site. You can update or remove/add your product lists whenever you like for no extra charge.
Option two: online ordering and payment Your customers can view your products and then order and pay online. Your product lists and pricing are created using our online facility; as a result, you can price daily/weekly specials easily, with products reverting to their normal retail price once the special is over. Your customers order and pay online before pick up or delivery of their goods and both your business and the customer receive an email summarising a customer order. Your business can send a message to alert the customer that their order is ready for pickup, or to arrange a delivery time that is convenient.
Irrespective of whether you choose Option 1 or Option 2, you will need to nominate on the Your local providore section if the goods are available for store pick up, home delivery for a charge, or free home delivery. You will also need to determine how customers picking up their orders are serviced to minimise the wait time for these customers.
Advertisements are uploaded by the Business. Advertisements may include an image and up to 15 words of text.
Small paid advertisements are either square 185 px wide by 165 px high (include up to 15 words), or rectangular 185 px wide by 250 px high (include up to 30 words). Advertisements are either standard rotating advertisements, or premium fixed advertisements. Advertisements may be purchased to be placed throughout the site, although they cannot be posted on another’s business profile page – only the particular business can advertise on its own site. One unit of advertising is one month.
Premium fixed advertisements: will occupy the top spot of the chosen page. It will not rotate, but is fixed for the period of time it is purchased. Only one premium advertisement can be listed on each page.
Standard, or rotating, advertisements will occupy the second to fourth advertisement. Up to four advertisements may rotate through a single advertisement spot.
Your Market Place reserves the right to inspect advertisements to ensure that they comply with our posting policy. Your Market Place may request changes be made or refuse to upload the advertisement if they deem it to be inappropriate in their absolute discretion. The approval process will be completed by Your Market Place within 72 hours.
When a customer searches for a business, search results will normally be shown in a random order. There are two paid listing options to help you maximise your business exposure: search page listings or default page listings.
Search listing option: Search page listings are displayed when a person searches for a business, for example, carpet cleaning in Lindisfarne. These listings do not apply to the whole region. You can choose to be either the first or the second on the search result. More information will be available on the website.
Default page listing: Default page listings are displayed when a member clicks through to a section of the site – for example, the Your local takeaways section – and a number of listings will be automatically displayed. As a result, there are extremely limited numbers for our default page listings. You can choose to be either the first, or in the second to fourth listing (position 2-4 is displayed in random order).
All payments to Your Market Place using the online credit card facilities are subject to the following Term and Conditions.

All transactions are processed in Australian Dollars (AUD $).
Once you sign up with Your Market Place, your credit card will be charged automatically each month. You can cancel your contract with us at any time, and your business profile will be disabled. You can choose to re-activate it with us at any time.
A 1.75% surcharge will be added to all credit card payments for Your local businesses profile pages.
We do not store your credit card details and payments to Your Market Place for Your local buy and sell's second hand market, are facilitated via PayPal.
PayPal allows you to choose to pay with your credit card, or with your PayPal account, and you are only charged when you choose to initiate the payment process.
After you have made your payment, you will receive an email confirmation.
Payments are debited to Your Market Place.
If your payment is unsuccessful, Your Market Place will not be advised why the payment has failed, therefore, you should contact your credit card provider for details. You can arrange an alternative payment method.
Requests for refunds are determined by the agreement in place between you and Your Market Place for the services provided. Please contact us for assistance with refund requests.
Payments will be processed using Secure Socket Layer (SSL) technology and your credit card number will be protected with a high level of encryption when transmitted over the Internet.
Your Market Place will not have access to your credit card details.
Your Market Place's Terms and Conditions for online credit card payments are subject to change at any time. Each transaction shall be subject to the specific Terms and Conditions that were in place at the time of the transaction.
